Service agreement
1. Definitions
- "The service" - the POSTEMA system for managing and publishing content in Facebook groups.
- "The company" - Diagram, which operates the POSTEMA system.
- "The user" - any person or entity using the service, following registration.
- "Content" - any text, image, file or other material the user publishes through the service.
- "Facebook account" - the Facebook account the user connects to the system for publishing.
2. Registration and age requirement
The service is intended for people over the age of 18 and for business owners engaged in lawful activity. Registration requires the provision of true and accurate details. The company reserves the right to refuse a registration or to close an account in circumstances it reasonably considers justified.
3. Trial and payment
The service is offered with a free trial period of 7 days, with no credit card required. At the end of the trial period, continued use requires a paid subscription according to the plan selected:
- Pro - ₪199 per month: unlimited publishing, scheduling, lead capture and post tracking.
- Pro + AI - ₪249 per month: everything in Pro, plus writing posts with AI (up to 100 posts per month).
Payment is made in advance for each month. Cancelling a plan takes effect at the end of the current billing period. There is no refund for part of a period.
4. User responsibility for content
The user is solely responsible for all content they publish through the service. The user undertakes:
- To publish lawful content only, which does not breach any law, regulation, copyright, privacy or third-party right.
- Not to publish offensive, misleading, spam, fraudulent or inciting content, or adult content without appropriate authorisation.
- To act in accordance with Facebook's terms of service and with the policies of the groups they post to.
- Not to use the service for any unlawful or improper purpose.
5. Usage restrictions
The following must not be done through the service:
- Attempting to breach, slow down or damage the service infrastructure.
- Sharing login details with third parties for commercial purposes.
- Automated use (bots) beyond the functions built into the system.
- Reverse engineering, copying or imitating the system's code.
6. The browser extension and access to the Facebook account
Publishing to groups is carried out by a Chrome extension installed on the user's computer and running inside their browser. The user acknowledges and understands that:
- The system does not ask for and does not store your Facebook password. The extension operates on top of the existing session in the browser.
- In order to operate the service, the extension accesses Facebook's login cookies in the browser. Those cookies are used solely to carry out the publishing actions the user initiated, and are not passed to any third party.
- Where cookies are stored on the company's servers for the purpose of scheduled actions, they are stored in encrypted form, and are deleted when the account is disconnected or deleted.
- The user may at any time remove the extension, disconnect the connection from the system or log out of Facebook, thereby ending access completely.
- Automated publishing in groups may conflict with Facebook's terms of use. Use of the service is at the user's own risk, including the risk of their Facebook account being restricted or blocked.
6a. Messaging and communications
- Operational messages. As part of providing the service, the user will receive messages relating to their account and to the operation of the service - including address verification, password reset, receipts and invoices, alerts about publishing status, enquiries received, alerts about the extension being disconnected, and notices about the end of the trial or subscription period. These messages are not advertising, they are an inseparable part of the service, and they will be sent for as long as the account is active.
- Delivery channels - email and WhatsApp. Operational messages will be sent by email to the address the user provided, and also by WhatsApp message to the phone number provided at registration. Providing a phone number at registration constitutes consent to receive operational messages through that channel. The user may at any time ask to stop receiving messages on WhatsApp, by replying to a message or by contacting support, and will then continue to receive them by email only.
- WhatsApp support group. On registration, a dedicated WhatsApp group may be opened to support the user, with company representatives as members. Joining the group is the user's choice, and they may leave it at any time without this affecting the service.
- Marketing messages. Messages concerning advertising, sales promotion, special offers, tips and product updates will be sent only to a user who has given explicit prior consent, through a dedicated and separate checkbox at registration or in the account settings screen. This applies to all delivery channels, including email and WhatsApp.
- Accepting these terms is not consent to marketing messages, and neither verifying an email address nor providing a phone number constitutes such consent. These are separate matters.
- Unsubscribe at any time. The user may withdraw their consent at any moment, without giving a reason and at no cost - through the unsubscribe link at the bottom of every marketing message, or in the account settings. The removal takes effect immediately.
- Unsubscribing from marketing messages does not affect the operational messages set out above, which will continue to be sent.
- Every marketing message will be marked as such and will include the advertiser's details and ways of contacting them, in accordance with section 30A of the Israeli Communications Law (Telecommunications and Broadcasting), 5742-1982.
7. Service availability
The company aims for 99% availability but does not guarantee continuous uninterrupted availability. Planned maintenance will be announced in advance. The company is not responsible for damages arising from service interruptions, whether planned or unforeseen.
Furthermore, changes to Facebook's interface may affect how the service functions. The company will endeavour to update the system accordingly but does not undertake to do so.
8. Intellectual property
All intellectual property rights in the POSTEMA system - including code, design, logo and content - are reserved to the company. Use of the service does not grant the user any right in the company's intellectual property.
The user grants the company a limited, royalty-free licence to use the content they create for the sole purpose of operating the service (for example, storing posts for scheduling).
9. Limitation of liability
The service is provided "as is". The company is not responsible for indirect, consequential or incidental damages arising from use of the service, including but not limited to: a Facebook account being blocked, damage to reputation, loss of customers, or errors in publishing.
The company's total liability will under no circumstances exceed the amount paid for the service in the last month.
10. Closing an account
The user may close their account at any time through the account settings. The closure takes effect at the end of the current billing period. After closure, the information is deleted within 30 days in accordance with the privacy policy.
The company reserves the right to close an account for breach of these terms of service, without prior notice and without refunding amounts already paid.
11. Changes to the terms
The company may update this agreement from time to time. Material changes will be brought to users' attention by email and/or a prominent notice on the site. Continued use of the service after notice of a change constitutes acceptance of the updated terms.
12. Governing law and jurisdiction
This agreement is subject to the laws of the State of Israel. Any dispute arising from this agreement will be heard by the competent court in the Tel Aviv-Yafo district, and to that end the user agrees to the exclusive jurisdiction of those courts.
